CREATO AI Subscription Cancellation and Refund Policy

Document version: 2.0 — Date of preparation: September 30, 2026.

1 Service and payment terms

CREATO AI is a digital cloud SaaS software service operated by EMRE ALAY; no physical goods or logistics shipping are involved. Access to the software is granted according to the purchased tier, completed account configurations, and activation credentials. Pricing, billing cadence, applicable taxes, commencement dates, and onboarding prerequisites are disclosed in the Order Summary prior to payment. Transactions are securely processed via iyzico.

2 Seven-day free trial

The trial period spans seven calendar days from the activation timestamp displayed to the user. Features, quotas, and capabilities vary by selected tier. Trial expiration does not unilaterally initiate a paid recurring subscription. Continuing with a paid subscription, total fees, initial billing date, and renewal conditions must be confirmed through separate affirmative opt-in.

Trial access is free of charge. If live WhatsApp messaging or third-party usage entails additional carrier costs, such fees and calculation metrics must be clearly disclosed and accepted by the Customer prior to dispatch. No billable dispatches are initiated without explicit approval. Following trial account closure, standard data export and deletion procedures apply.

3 B2B subscription cancellation

Customers may disable automatic subscription renewal directly via the platform billing dashboard or by sending written cancellation notice to hello@creato.digital from their registered account email. Cancellation procedures will not impose burdensome obstacles or verification requirements beyond those needed to verify administrative authority. Written confirmation of cancellation and effective termination dates are provided.

Cancellations received prior to the start of a subsequent billing cycle ensure that no renewal fees are charged. Mandatory cutoff buffers, such as requiring cancellation 24 hours in advance, are not enforced. In standard B2B cancellations, access continues until the end of the paid billing period. In B2B relationships, unused days or unexhausted quotas do not constitute grounds for pro-rata refunds. Defective service performance, material contractual breach, unauthorized billing, and statutory rights remain excepted.

Account deletion and subscription non-renewal are distinct actions; their respective impacts are clearly indicated. An explicit cancellation request will not be treated merely as a routine data deletion command without addressing subscription billing.

4 Additional usage and third-party fees

Additional quotas, plan upgrades, and variable usage fees require explicit confirmation. Where an upgrade was not delivered or billing errors occurred, appropriate corrections are made immediately. Retaining fees for utilized quotas in standard commercial cancellations does not grant the right to retain funds for unperformed or defective services.

Carrier fees for Meta/WhatsApp and other third-party services must strictly reflect verified supplier usage logs. Charges not levied by upstream providers will be refunded to the Customer; Provider remains obligated to correct erroneous or duplicated charges resulting from software bugs. Refund assessments for third-party charges evaluate upstream network policies and Provider's own technical performance.

5 Service non-performance by Provider

Where the Service cannot be substantially provided, is prematurely terminated without cause, or suffers an uncured material breach, Customer may exercise statutory and contractual termination remedies. Prepaid fees for unperformed service periods will be refunded promptly. In curable breaches, a seven-day remediation notice is provided unless immediate action is required.

Normal third-party network latency is distinguished from Provider's own culpable non-performance. Not all temporary interruptions trigger automatic refunds; service scope, duration, operational impact, and governing law are evaluated. Provider's refund obligations cannot be extinguished via general liability caps.

6 Consumer right of withdrawal

For natural persons acquiring services for personal, non-commercial, and non-professional purposes (qualifying as consumers under statutory consumer protection law), mandatory consumer protections govern. Under distance service contracts, consumers are entitled to withdraw from the contract within fourteen days of contract formation without stating reasons. Statutory consequences for inadequate pre-contract disclosures remain reserved.

Continuous cloud SaaS access does not automatically qualify as an “instantaneous digital service executed immediately in full”. Statutory withdrawal exemptions apply only where genuine delivery models and legal criteria are fulfilled. Where service performance begins before expiry of the withdrawal period based on the consumer's explicit prior request, applicable statutory exemptions must be disclosed in advance; pre-ticked boxes or bundled consent clauses are void. If performance has not commenced, exemptions cannot be invoked. Digital deliveries performed immediately in full remain evaluated separately under applicable law.

Upon valid exercise of withdrawal rights, statutory refunds are executed within fourteen days of receiving the notice without imposing costs or deductions on the consumer. Statutory warranty remedies for defective services operate independently of withdrawal rules.

7 Consumer subscription termination

Indefinite-term consumer subscriptions or fixed-term subscriptions with a duration of one year or longer may be terminated at any time without penalty or stating cause. For fixed-term consumer subscriptions shorter than one year, statutory termination rights apply where contractual terms change or valid justification exists.

In consumer subscriptions, termination requests are fulfilled within at most seven days; shorter statutory periods favoring consumers prevail. Unused prepaid balances and security deposits are refunded within fifteen days of termination taking effect. B2B non-refund rules cannot be enforced against statutory consumer rights.

Fixed-term consumer subscriptions cannot be extended automatically via general boilerplate contract clauses. Extensions require separate consumer request or consent following contract formation. Recurring billing under indefinite-term contracts is distinguished from automatic extension of fixed-term contracts.

8 Refund processing and contact details

Refunds are processed via iyzico back to the original payment instrument within statutory timeframes. Banking settlement schedules may vary; however, this does not extend Provider's obligation to initiate refunds within prescribed legal deadlines. Deductions or alternative store credits cannot be forced on consumers for mandatory statutory refunds.

Refund inquiries should state account/order identifiers, request details, and contact information; full payment card numbers or CVC security codes must never be shared. Contact: EMRE ALAY — CREATO AI, hello@creato.digital; Şemikler Mah. 6250 Sk. No:5 D:3 Karşıyaka/İzmir, Türkiye. Statutory rights to apply to Consumer Arbitration Committees and Consumer Courts remain reserved.
