CREATO AI Commercial Electronic Messages and Marketing Preferences
Document version: 2.0 — Date of preparation: September 30, 2026.
1 Scope of dispatches
This notice outlines promotional messages, product announcements, discounts, events, and marketing communications sent to you by EMRE ALAY on behalf of the CREATO AI brand. For marketing campaigns dispatched by business customers using the platform to their own clientele, the respective merchant's own notices and consents apply; such merchants must also comply with the WhatsApp Marketing Special Terms.
2 Consent and channel selection
In optional marketing communications, clear choices are presented detailing sender identity, promotional purpose, and transmission channel. Email and WhatsApp preferences are displayed separately; selection boxes are never pre-checked. Purchasing a subscription, activating a free trial, requesting a demo, or connecting a store does not constitute marketing consent.
Commercial electronic message consents and personal data processing based on explicit consent are explained and recorded separately in compliance with applicable law (including Turkish Law No. 6563 and KVKK). Unnecessary explicit consent is not demanded for processing grounded in independent statutory bases. Where message registry (IYS) obligations apply, consent and opt-out records are synchronized within statutory timeframes. Even where statutory opt-in exceptions apply, recipient opt-out choices and channel-specific guidelines are strictly respected.
3 Transactional service updates
Transactional updates necessary to perform the service—such as payment receipts, invoices, security alerts, critical account notifications, and direct customer support responses—may be dispatched under applicable contractual legal grounds. Promotional marketing content will not be bundled into transactional messages to circumvent opt-in requirements. Refusing optional marketing communications will never restrict access to paid core services.
4 Opt-out and revocation of consent
You may opt out of marketing communications free of charge at any time via unsubscribe links in emails, clear opt-out replies in WhatsApp, or by sending notice to hello@creato.digital. Opt-out mechanisms are easily accessible directly within the communication channel. Statutory message registries (such as IYS) may also be used where applicable.
Upon receiving an opt-out request, promotional dispatches cease promptly, and at most within three business days under applicable commercial electronic messaging regulations. Opting out of a specific channel is clearly distinguished from opting out of all channels; broad opt-out requests are never artificially narrowed. Dispatches will not resume without fresh, valid consent.
Canceling a paid SaaS subscription is a distinct procedure. Opting out of marketing communications does not trigger subscription cancellation fees or terminate active software subscriptions; explicit cancellation requests are handled under the Subscription Cancellation and Refund Policy.
5 Records and data protection
Sender identity, transmission channels, presented notice versions, timestamps of consent, and opt-out logs are retained for consent verification and evidentiary compliance. Statutory retention periods under commercial messaging legislation govern; audit logs are not repurposed for advertising targeting. Detailed personal data processing terms are set forth in the KVKK Information Notice.
